Welcome to the Mark of Life website (“Website”), an initiative of FCancer (“Organization”). Mark of Life is a storytelling and tattoo community platform built to inspire, educate, and empower individuals impacted by cancer.

This Agreement (“Terms and Conditions”) governs your access to and use of the Website and any related services (“Services”).

Important: While Mark of Life is operated under the FCancer brand, FCancer is not a tattoo provider and assumes no liability for tattoo services, artist interactions, or user activities conducted on or through the Website.

By accessing or using the Website, you (“User,” “You”) agree to be legally bound by these Terms. If you disagree, do not use the Website.

Mark of Life reserves the right to update or modify these Terms at any time without prior notice. Continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use this Website. If you are under 18, you must have the consent of a parent or guardian.

3. Services and Community

Mark of Life provides a digital space for:

This Website does not provide or broker tattoo services. All interactions between Users and artists occur independently and are at the sole discretion and responsibility of the parties involved.

4. Tattoo Artists

By registering as or engaging with the platform as a tattoo artist, you agree to:

  • Provide accurate and up-to-date information about your professional credentials.
  • Maintain all required licenses, permits, and insurance to provide tattoo services in your jurisdiction legally.
  • Comply with all health, safety, and sanitation regulations applicable to your practice.
  • Acknowledge that FCancer and Mark of Life are not your employer, agent, or business partner and have no role in your services, pricing, scheduling, or client interactions.

Mark of Life reserves the right to remove an artist’s profile or deny participation for any violation of these Terms or community guidelines.

5. Users

By using this Website as a User, you agree to:

  • Use the platform for lawful purposes only.
  • Understand that Mark of Life does not guarantee or vet tattoo artist qualifications beyond basic platform guidelines.
  • Acknowledge that any tattoo appointment, payment, or service arrangement is between you and the tattoo artist only.
  • Seek professional medical advice before undergoing tattoo procedures, if applicable.

6. Content Ownership

All content displayed on the Website—including text, graphics, images, logos, and audio/video content (“Content”)—is the property of FCancer or its licensors and protected by U.S. and international copyright laws.

You may not:

  • Reproduce, distribute, or exploit Website Content for commercial use without written consent.
  • Misrepresent your identity or affiliation.

11. Indemnification

You agree to indemnify, defend, and hold harmless FCancer, its affiliates, partners, officers, employees, and contractors from any claims, damages, liabilities, or expenses (including attorney’s fees) arising from:

  • Your use of the Website.
  • Your interactions with tattoo artists or other Users.
  • Your violation of this Agreement or applicable law.

12. Unenforceable Provisions

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

13. Governing Law

The laws of the State of California, United States, govern this Agreement. You agree to submit to the exclusive jurisdiction of the courts located in California to resolve any disputes arising under these Terms.

14. Waiver

No waiver of any provision shall be deemed a continuing waiver or a waiver of any other provision. Any waiver must be in writing and signed by the party granting it.

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Mark of Life / FCancer regarding use of the Website and supersede all prior agreements.
